ANKARA - HDP Law and Human Rights Commission will submit their pre-defense to the Constitutional Court today at 16.00 pm regarding the closure case against their party.
The Peoples’ Democratic Party (HDP) Law and Human Rights Commission will submit the pre-defense of the closure case brought against the HDP by the Supreme Court of Appeals Prosecutor’s Office to the Constitutional Court today at 16.00 pm. In addition, HDP Law and Human Rights Commission is expected to hold a press conference on the issue at 11:00 am tomorrow at HDP Headquarter.
The time given by the Constitutional Court, which accepted the closure case against the HDP on June 21, until 7 September for the first defense, was extended by two months upon the HDP’s request. The deadline given to HDP ends tomorrow. The defense prepared by the commission formed under the chairship of HDP Vice Co-Chair Ümit Dede who is responsible for the Law and Human Rights and consists of 11 people will be submitted to the Constitutional Court today.
After HDP gives the defense to the Constitutional Court, the file will be sent to Supreme Court of Appeals Prosecutor Bekir Şahin. The Chief Prosecutor must submit his opinion as to the accusations within one month. After the opinion to be submitted by the Prosecution Office, HDP will be given one month to prepare its main defense.
ECtHR decisions
During the defense preparations, HDP Law Commission examined into the lawsuits and decisions brought against political parties, including the ruling party AKP, in Turkey, as well as the violation decisions given by the European Court of Human Rights (ECtHR) and the reports prepared by the Venice Commission. After the HDP Closure Case was accepted on June 21, the HDP Law Commission, which continued its work, finished the main axis of the defense. The defense was prepared with the suggestions and supports taken from academics and lawyers who are experts in their fields, apart from the commission.
Expressing at every opportunity that the closure case is political rather than legal, HDP will draw attention to the conspiracy operations against their parties, carried out by the judiciary under the custody of the government, and the place and importance of the HDP in Turkish democracy.
